These Terms of Service ("Terms") govern your use of the Listd mobile application ("App") operated by Prairie Nomad Technologies ("we," "us," or "our"). By creating an account or using the App, you agree to be bound by these Terms.
You must be at least 18 years of age to use Listd. By using the App, you represent that you are 18 or older and have the legal capacity to enter into these Terms.
Listd is a For Sale By Owner (FSBO) platform exclusively for private property sellers in Saskatchewan, Alberta, and Manitoba. By creating a listing, you confirm that:
Listings found to be posted by licensed real estate agents or brokerages will be removed without refund. Prairie Nomad Technologies reserves the right to remove any listing at any time for violation of these Terms.
To use Listd, you must create an account with a valid email address. You are responsible for:
We reserve the right to suspend or terminate accounts that violate these Terms.
When you create a listing, you agree that:
We reserve the right to remove listings that we determine, in our sole discretion, are inaccurate, misleading, fraudulent, or in violation of these Terms.
Listing fees are charged at the time of publication and are non-refundable, except as required by applicable law. Current pricing:
Add-on fees apply for extensions, upgrades, and relisting. All prices are in Canadian dollars and include applicable taxes where required.
Payments are processed by Stripe. By completing a payment, you agree to Stripe's Terms of Service. We do not store your payment card information.
Listings expire after 90 days from the date of publication. Expired listings are removed from the App but remain in our database. You may extend or relist your property for an additional fee.
Listd provides tools to facilitate offers between buyers and sellers. However:
The in-app messaging system is provided for communication between buyers and sellers. You agree not to use messaging to:
We reserve the right to monitor messages for compliance with these Terms and to remove users who violate them.
You agree not to:
All content, features, and functionality of the App — including but not limited to text, graphics, logos, and software — are owned by Prairie Nomad Technologies and protected by Canadian and international copyright laws.
You retain ownership of content you submit (photos, videos, listing descriptions). By submitting content, you grant us a non-exclusive, royalty-free licence to display, reproduce, and distribute your content solely for the purpose of operating and promoting the App.
The App is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that:
To the maximum extent permitted by applicable law, Prairie Nomad Technologies shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to loss of profits, data, or goodwill.
Our total liability to you for any claim arising from these Terms or your use of the App shall not exceed the amount you paid us in the 12 months preceding the claim.
You agree to indemnify and hold harmless Prairie Nomad Technologies and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the App, your listings, or your violation of these Terms.
These Terms are governed by the laws of the Province of Saskatchewan and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Saskatchewan.
We may update these Terms from time to time. We will notify you of material changes by posting a notice in the App or sending you an email. Your continued use of the App after changes take effect constitutes your acceptance of the updated Terms.
